By accessing and using FreshTalent ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use this Service.

These Terms of Service apply to all visitors, users, and others who access or use the Service, including job seekers, employers, and any other parties.

2. Description of Service

FreshTalent is an online job aggregator platform operated by ABODigital Pty Ltd that connects job seekers with employment opportunities, internships, graduate programmes, learnerships, and bursary information across South Africa.

Our service includes verified job listings, application management, career resources, CV checking tools, and educational funding opportunities. We aggregate opportunities from multiple sources and verify them before publication.

3. User Accounts

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your password
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorised use of your account

4. User Responsibilities

As a user of our Service, you agree to:

• Use the Service only for lawful purposes
• Provide truthful and accurate information in all interactions
• Respect the intellectual property rights of others

5. Job Applications & Listings

For Job Seekers

• Job listings are sourced from third-party employers and verified by our team
• We do not guarantee employment or interview opportunities
• You are responsible for the accuracy of your application materials
• Employers may contact you directly regarding your applications
• Application data may be shared with the relevant employer

For Employers

• Job postings must comply with applicable South African employment laws
• You are responsible for the accuracy of job descriptions and requirements
• We reserve the right to remove listings that violate our policies
• Premium listing features may require payment

6. Payment Terms

For premium services and features:

• Payments are processed securely through third-party payment providers
• All fees are quoted in South African Rand (ZAR) and are non-refundable unless otherwise stated
• Subscription fees are billed in advance on a recurring basis
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
• Price changes will be communicated at least 30 days in advance

7. Intellectual Property

The Service and its original content, features, and functionality are owned by FreshTalent and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of any content on our platform without prior written consent.

8. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to:

• Warranties of merchantability and fitness for a particular purpose
• Warranties regarding the accuracy or reliability of information
• Warranties that the Service will be uninterrupted, timely, or error-free
• Warranties regarding the results obtained from use of the Service

9. Limitation of Liability

To the maximum extent permitted by applicable law, FreshTalent shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the Service
• Any conduct or content of any third party on the Service
• Unauthorised access, use, or alteration of your data
• Any employment decisions made based on information found on the Service

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

11. Governing Law

These Terms shall be interpreted and governed by the laws of the Republic of South Africa, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
